Motorcycle Accidents

Recent figures released by Highway Safety indicate that fatalities from motorcycle accidents are 37 times higher than those of car crashes mostly because motorcyclists do not have the benefit of protective measures like airbags and safety belts. Apart from increase fatalities, motorcyclists are also often injured very seriously in accidents. As a result motorcyclists often suffer head- or spinal cord injuries that need extensive medical intervention and long periods of rehabilitation.

Another disturbing statistic is that, despite a decline in road fatalities, motorcycle crashes and fatalities have continued to rise.

Recent statistics have shown that many motorcyclists have inadequate training in how to operate their sometimes very powerful machines. Motorcyclists are also sometimes the victims of road rage and should learn some defensive driving to keep them safe.

Recent surveys have shown that motorcyclists pinpoint distracted and inattentive drivers as the most dangerous hazard on the road.

If you have been involved in motorcycle accident it is important that you first report the accident. Most states require that an accident be reported as soon as possible. Make sure that the police report reflect your version of how the accident happened. Also remember to get the names and contact details of any eyewitnesses.

If you have been injured in a motorcycle accident through the negligence of another driver, you are entitled to be compensated for your damages. Damages will typically include the payment of medical bills for accident-related treatment and for any future treatment or operations needed; compensation for loss of earnings, both after the accident and possibly in the future, for pain and suffering and loss of the enjoyment of life.

Damages claims arising from a motorcycle accident can get tricky and it will be a good plan to involve a specialized attorney to handle the claim on your behalf.  Attorneys will, for instance, have access to the services of crash experts who will be able to reconstruct the way the accident happened as to accurately determine negligence. Good motorcycle accident lawyers will also be assisted by medical specialists and actuaries to assist them in accurately calculating the damages.
Courts will expect motorcycle drivers to act responsibly, be able to handle their machines and wear the correct protective gear including helmets and the necessary eye protection. It might happen that a court finds that a motorcyclist had contributed to the damages suffered during an accident. This will lead to the total amount of damages being reduced to reflect the percentage of comparative negligence on behalf of the motorcyclist. Similarly courts will expect motorists to share the road with motorcyclists and not to drive in a way that can put them in danger.
